Work Permits

Work/Residence Permits are issued to any Non-Kenyan wishing to engage in employment in Kenya whether in gainful employment or voluntary service. These Work/Residence Permits are issued by the Department of Immigration Services under the Ministry of Interior and Coordination of National Government. The permits are classified from A to M. They are issued under Kenya Citizenship and Immigration Act 2011 of Laws of Kenya. The following are the various classes of permits and their respective requirements:

Class A:   Issued to persons who intend to engage in prospecting for minerals or mining.
Class B:   Work permit issued to persons wishing to invest in Agriculture and Animal Husbandry.
Class D:   This issued to a person who is offered specific employment by a specific employer who is qualified to undertake that employment.
Class G:   Work permit issued to investors in specific trade, business or consultancy.
Class I:  Work/Residence permit issued to a member of missionary society approved by the Government of Kenya and whose presence is beneficial to the country.
Class K:  Residence permit issued to persons who have an assured income derived from sources outside and undertakes not to accept paid employment of any kind.
Class M: Work permit issued to Conventional Refugees.

Special Passes

A special pass is a document issued to person(s) given specific employment by specific employer for a short duration not exceeding three (3) months or those receiving education or training at an educational or training establishment within the country by which he/she has been accepted as a student/pupil.

Tourism Regulatory Authority gives recommendations for work permits and special passes to persons seeking employment in the tourism sector under class D and investors in the sector under class G.The Authority has establishment a committee that vets and gives recommendations to Department of Immigration Services.
Applicants for renewal of entry permits are advised to submit their applications to TRA at least four months prior to expiry date.

Requirements for Entry Permit: Class G (Investor)
•    Copy of completed application Form 2.5 for entry permit
•    A detailed letter explaining the purpose of the entry and addresses to the Principal Secretary, Ministry of East African Affairs, Commerce and Tourism, through the Director General, Tourism Regulatory Authority
•    Copy of passport of the applicant
•    Copy of current entry permit (renewal cases only)
•    Copy of relevant tourism license (where applicable)
•    Certificate of incorporation of the company
•    Memorandum and Articles of Association of the company
•    Company/applicants PIN number(where applicable) and Tax clearance certificate
•    Audited accounts of the company (renewals only)
•    Financial statements vetted by bank official (to indicate level of capital to be invested in the business)
•    Expatriate profile (details of  all expatriates in the company)

Requirements for Entry Permit: Class D (Employee)
•    Copy of completed application Form 2.5 for entry permit
•    A detailed letter explaining the purpose of the entry and addresses to the Principal Secretary, Ministry of East African Affairs, Commerce and Tourism, Through the Director General, Tourism Regulatory Authority
•    Copy of passport of the applicant
•    Copy of current entry permit (renewal cases only)
•    Copy of relevant tourism license (where applicable)
•    Expatriate profile (details of expatriates in the company)
•    Testimonials of the applicable translated into English language (new cases only)
•    Testimonials of the understudy (to work under the applicant), cv and id copy
•    Certificate of incorporation of the company
•    Applicants pin number(where applicable)
•    Original set or entry documents for Department of Immigration among other requirements that may be requested
•    Report on the understudy during the previous term (renewal cases)
•    Letter of intent of engagement(renewals)

The Department of Immigration Services may request for other documents as may be deemed necessary.
